Federal and state fair housing laws exist to ensure equal access to housing for everyone. These laws prohibit discrimination in real estate transactions based on:
- Race
- Color
- Religion
- Sex (including gender identity and sexual orientation)
- Disability
- Familial status
- National origin
Key Federal Laws
Civil Rights Act of 1866
Prohibits discrimination in housing based on race or color in the sale or rental of property.
Civil Rights Act of 1968 (Title VIII)
Expanded protections to include race, color, religion, and national origin.
Fair Housing Amendments Act of 1988
Amended the 1968 Act to include protections based on sex, disability, and familial status. Together, these laws form what is commonly known as the Fair Housing Act.
Americans with Disabilities Act (ADA)
Title III prohibits discrimination against individuals with disabilities in places of public accommodation and commercial facilities.
Equal Credit Opportunity Act (ECOA)
Prohibits discrimination in credit transactions based on race, color, religion, national origin, sex, marital status, age, or receipt of public assistance.

Sellers’ Responsibilities
Home sellers and landlords may not discriminate in the sale, rental, or financing of property based on protected characteristics. Discriminatory terms, conditions, advertising, or misrepresentation of availability are prohibited. Sellers may not instruct a real estate professional to discriminate.
Real Estate Professionals’ Responsibilities
Real estate agents, brokers, mortgage professionals, and loan officers must comply with fair housing laws and may not discriminate or follow discriminatory instructions from clients.
